What is the Cures Act final rule for electronic health information?

The Cures Act Final Rule requires all “actors” to prevent actions that “interfere with, prevent, or materially discourage access, exchange, or use of electronic health information (EHI),” with a few exceptions.

How is VPI diagnosed and treated?

How is VPI diagnosed? A speech pathologist can determine whether the speech deficit is caused by VPI or another speech disorder. A nasoendoscopy is used to view palatal motion during speech and to determine the size and shape of the velopharyngeal gap.

What is velopharyngeal insufficiency (VPI)?

Velopharyngeal insufficiency (VPI) is when the soft palate does not close tightly against the back of the throat, leading to air coming out the nose (characterized by hypernasality and/or nasal air emission) during speech. This can cause speech that is difficult to understand.

What is the exclusions process at OIG?

OIG's exclusions process is governed by regulations that implement sections of the Act. When an individual or entity gets a Notice of Intent to Exclude (NOI), it does not necessarily mean that they will be excluded. OIG will carefully consider all material provided by the person who received the NOI as we make our decision.

What is content condition?

Content Condition: Establishes the content an actor must provide in response to a request to access, exchange, or use EHI in order to satisfy the exception. concerning the required content (i.e., scope of EHI) of an actor’s response to a request to access, exchange, or use EHI and the manner in which the actor may fulfill

Is EHI information blocking?

It will not be information blocking if an actor does not fulfill a request to access, exchange, or use EHI in order to protect an individual’s privacy, provided certain conditions are met.

Can an actor disclose EHI?

However, an actor should not be required to use or disclose EHI in a way that is prohibited under state or federal privacy laws.
